Request For Excess Funds

The list of properties this office sold by Sheriff Sales conducted 11/08-6/09 are attached.   We interplead all excess funds over $1000 to the Superior Court of Henry County.  You would have to contact the Clerk of Superior Court of Henry County as to the format they require for requesting those funds. 

The procedure to request funds (under $1000) still held by this office from Sheriff Sales, is as follows:

Please send a written, signed and notarized request to 140 Henry Parkway, McDonough, GA  30253, citing your recorded interest in the property (with a title opinion if possible).  Funds are available for distribution to entitled parties in order of priority in which their interest exists.  These funds are maintained by this office for 5 years after which time they are turned over to the Georgia Department of Revenue.

Currently we are conducting Judicial Sales only.  All excess funds are turned over to the Clerk of Superior Court after the 60 day Right of Redemption has expired.
